and participation

1. Purpose of the service​

The provider, operating under the trade name A Stranger in Roma, offers the following personalised experiences:

• Rome in Motion (4 Hours)

• Chic & Intimate Shopping (2 Hours)

• Stylish Discovery & Shopping (4 Hours) Rome,

• Style & Leisure (8 Hours)

These experiences may include, depending on the case, lifestyle walks, curated shopping, cultural accompaniment, style coaching, or other immersive activities.

They are designed to be inspiring, cultural, and tailor-made, without constituting a travel agency, transport company, or organised tourist service as defined by the Italian Tourism Code. ​

At this stage, the services are offered on an occasional, non-continuous basis and are subject to limited availability.
They do not constitute a permanent or established professional activity.​

The names, durations, and formats of the experiences are indicative and may be adapted on a case-by-case basis.

​The services are provided pursuant to Article 2222 of the Italian Civil Code, as an occasional, non-habitual, and non-organized activity.

​

Participants must be physically able to take part in the experience, including walking, standing, and moving through city streets. Participation is at their own discretion and responsibility. ​

​

No historical, artistic, or official guiding services are provided, and no information should be interpreted as licensed tour guiding.

The provider acts exclusively as a lifestyle accompanist and curator and does not provide guided tours, historical explanations, transportation services, or travel arrangements as defined by applicable Italian or European regulations. ​

 

​​2. Booking and payment

Bookings are made exclusively through the official website (hosted on Wix) or through selected third-party partners, on an occasional basis

Payment is requested upon confirmation of availability.
The booking becomes effective only after confirmation and receipt of payment.

​

In the event of a payment error or technical issue, the booking will only be confirmed after actual receipt of the full amount.

 

Certain services, including those involving external providers (such as private transport NCC, meals, or special events), may be subject to specific pricing conditions, indicated on the corresponding booking page.

 

3. Cancellation and refund

Cancellations must be requested by email at the address indicated on the website. ​

• Up to 7 days before the scheduled date: full refund of the amount paid.

• From 7 days before the scheduled date: 70% refund.

• Less than 24 hours before the experience or in case of no-show: no refund. ​

 

Any transaction or banking fees related to refunds may be deducted from the reimbursed amount.

No compensation or refund shall be granted for temporary closures of third-party venues or establishments included in the experience.

 

For services involving external providers (such as NCC private transport), non-refundable costs may apply if the cancellation occurs less than 72 hours before the scheduled service.

These details will be provided when booking. ​

 

Cancellation by the provider :

In case of exceptional cancellation by the provider (personal impediment, safety conditions, or force majeure), the participant will receive a full refund of all sums paid.

This refund constitutes full and exclusive compensation; no other indemnity, compensation, or damages may be claimed for any reason whatsoever.

 

4. Service execution

Experiences take place exclusively in Rome and its surroundings, on foot or using regular public or private transport (at the client’s own expense unless explicitly included).

Schedules, meeting points, and durations are indicated upon confirmation and may vary slightly depending on season, availability, and local conditions.

 

Late arrivals (more than 20 minutes) may result in a shortened experience without refund. ​

 

Certain experiences include private transport provided by a licensed professional driver (NCC). This service is booked by A Stranger in Roma for the participant’s comfort but remains performed under the exclusive responsibility of the transport provider.

The price paid upon booking covers the full service, including transport costs when explicitly included.

 

A Stranger in Roma acts solely as an intermediary and shall not be held liable for delays, incidents, damages, cancellations, or failures attributable to the transport provider.

 

Transport provider details (business name, NCC registration) may be communicated to the client prior to departure. The provider’s general conditions apply to any transport portion of the experience. ​

 

All experiences include a personalization form sent after booking to define the meeting point, style preferences, sizing, expectations, and any specific requirements.​ ​

 

Participants are fully responsible for their personal belongings, physical condition, conduct, and decisions, including purchases.

Participants acknowledge that the experiences may involve walking, standing, and moving through city streets and public spaces, and confirm that they are physically able to do so.

Participants must comply with local laws and respect public spaces, venues, and third-party partners.

 

The provider is not responsible for the pricing, quality, availability, opening hours, or policies of third-party boutiques, cafés, or venues.

No contractual relationship is established between the provider and any third-party venue, merchant, or service provider visited during the experience.

 

The itinerary and timing are indicative and may be adapted depending on weather conditions, accessibility, opening hours, safety considerations, or unforeseen circumstances.

At no time does the provider assume a role of supervision, custody, or control over the participant.

The participant remains autonomous at all times and is solely responsible for their movements, decisions, and personal safety throughout the experience. ​

 

5. Participation conditions ​

Participants must be adults (18 years or older).

Rome in Motion: maximum 3 participants

All shopping experiences: maximum 1 participant

 

Participants confirm that they are physically able to take part in the experience and participate at their own discretion. Participants must behave respectfully toward the places visited, local partners, and the guide-accompanist. ​

 

6. Liability and insurance

A Stranger in Roma undertakes to deliver the service with due care, attention, and good faith, within the scope of a non-continuous and non-established activity.

However, the provider cannot be held liable in the event of:

• any incident, loss, theft, injury, or damage occurring during or as part of the experience,

• adverse weather conditions,

• delays or modifications due to causes beyond its control. ​​

​

In no case shall the provider be held responsible for indirect, consequential, or immaterial damages (such as loss of profit, image, time, or opportunity).

 

A Stranger in Roma may only be held liable in the event of proven fault directly attributable to the provider in the execution of the service.

No liability shall arise from risks inherent to urban environments, including but not limited to uneven pavements, traffic, weather conditions, crowd density, or the conduct of third parties. ​​ ​

 

Participants are strongly advised to hold personal travel and civil liability insurance adequate for urban walking activities and lifestyle experiences. ​

Private transport included in certain experiences is provided by an independent licensed driver (NCC).

While A Stranger in Roma carefully selects its partners, it assumes no liability for their performance.

Responsibility for transport — including punctuality, safety, and potential delays or cancellations — rests solely with the transport provider. ​

 

7. Programme modification

The provider reserves the right to make any necessary changes to the schedule, route, or venues in case of force majeure, safety reasons, or feasibility issues. ​ ​

In such cases, an equivalent service will be offered, without giving rise to a refund.

The provider shall not be held liable if the service cannot be delivered or must be interrupted due to events beyond its control, including illness, injury, accident, theft, medical or administrative emergencies, extreme weather, strikes, administrative restrictions, or any other unforeseeable event rendering performance impossible or unsafe.

In such cases, the service may be rescheduled or adapted without compensation or refund.

 

Refunds specified in these Terms constitute full and exclusive compensation and shall not give rise to any additional damages or interest. ​

 

8. Good faith and cooperation clause

Participants agree to cooperate in good faith with the provider to ensure the proper delivery of the service.

Any inappropriate, disrespectful, or unsafe behaviour may result in the immediate termination of the experience, without refund. ​

9. Media and image release clause

During certain experiences, photos or video recordings may be taken for communication or promotional purposes.

By participating, the client grants a non-exclusive, royalty-free, and perpetual right for A Stranger in Roma to use their image in such materials, unless written objection is sent prior to the experience.

This authorisation applies to all digital and social media platforms related to A Stranger in Roma.

The participant may withdraw consent in writing at any time for future publications. ​

 

10. Intellectual property

All texts, content, images, concepts, and names related to A Stranger in Roma remain the exclusive property of their creator. Any reproduction, distribution, or use, in whole or in part, without prior written consent, is strictly prohibited. ​

 

11. Personal data protection

Information collected during booking or via the preliminary questionnaire is strictly confidential and used solely for the organisation of the booked experience.

Data will not be sold or transferred to third parties, except for partners essential to the proper performance of the service (e.g. NCC transport provider).

 

12. Booking made by a third party

If the booking is made on behalf of a third party, the person making the booking agrees to transmit these Terms in full to the participant, who will be bound by them once the service begins. ​

 

13. Severability and entire agreement

If any clause of these Terms is found invalid, the remaining provisions shall continue in full force and effect.

Failure by the provider to enforce a clause at any given time shall not be interpreted as a waiver of its right to enforce it later.

 

These Terms and Conditions apply regardless of the current development stage of the activity, including any testing or limited operational phase.

​ 14. Language and interpretation

These Terms and Conditions may be translated into other languages for convenience only.

In case of any discrepancy or divergence in interpretation, only the Italian version shall prevail and have legal value. Translations in other languages are provided solely for the convenience of international users and do not create any independent legal rights or obligations. ​

 

15. Applicable law and jurisdiction

These Terms are governed exclusively by Italian law, regardless of the language used on the website or in the documents. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the courts of Rome, Italy.

 

 

 

​ ​ ​ ​ ANNEX – INDIVIDUAL LIABILITY WAIVER ​​

 

By confirming my booking, I acknowledge and accept that: ​

• I am voluntarily participating in a cultural and lifestyle experience in Rome.

• I understand that I take part in a cultural discovery activity not supervised by an official tour operator.

• I remain fully responsible for my safety, belongings, physical condition, physical readiness, and choices throughout the experience.

• I confirm that I am in good health and physically able to walk, stand, and move comfortably through city streets and public spaces.

• I am solely responsible for any medical condition, allergy, or health issue and for carrying any necessary medication.

• I understand that A Stranger in Roma is not responsible for the pricing, quality, availability, or policies of third-party boutiques, cafés, or venues.

• The provider cannot be held liable for any incidents, losses, damages, or injuries occurring during the experience, including those happening while walking or visiting public areas.

• I have read and understood the cancellation and refund conditions.

• I accept that programme variations may occur without financial compensation.

• During journeys in a private vehicle (NCC), I undertake to comply with all safety instructions and remain seated with my seat belt fastened.

• A Stranger in Roma cannot be held liable for any incident occurring during transport provided by a third party.

• Participation takes place at my own discretion and risk, and I understand that urban environments may present inherent risks (such as uneven surfaces, traffic, weather conditions, or crowd density).

• I understand that the experience does not involve supervision, guardianship, medical assistance, or safety oversight, and that the provider does not assume any obligation of protection beyond lifestyle accompaniment.

• I acknowledge that I am not under the authority, supervision, or control of the provider during the experience.

• I expressly waive, to the extent permitted by applicable Italian law, any civil claim or legal action against A Stranger in Roma for damages arising from my participation, except in cases of proven gross negligence or intentional misconduct.

• ​I confirm that I have had sufficient time to read these documents and that my acceptance is informed, voluntary, and unconditional. ​ ​
